This is to inform you that the TRAG Board has now been threatened with law suits by Pet Owners and Non-Pet Owners in TRAG.

This is a “damned if you do damned if you don’t” situation which requires the Board’s political will to do the right thing.

It has always been the objective of the present Board of Trustees to implement rules and regulations in TRAG for the common good.

BACKGROUND:

A.    The TRAG Board and Management has the responsibility of implementing the stipulations in the Master Deed.

 

2.5 Section A of the Master Deed and Restrictions, ’’…The Owner shall not keep any animal in the Residential Unit nor shall anything be done therein or emanate there from which may become an annoyance or nuisance to the other Owners or which constitutes a violation of any law or regulation… ”.

 

The No Pet Policy stipulation can only be amended by a 100% vote of all unit owners.

This policy is one stipulation which made others buy their units in TRAG, perhaps because of allergies to pet fur, and feces; cynophobia (fear of dogs); fear of rabies; noise caused by barking dogs; and for other personal reasons.  Therefore, they have every right to insist that pets should never be allowed in TRAG as stipulated in the Master Deed.  

B.     The existing dogs allowed in TRAG was a result of an accommodation by the past members of the Board who happened to have dogs themselves. 

While some may claim that they were allowed by Ayala to have pets, sadly Ayala has nothing to do with circumventing the Master Deed.

C.     In March 2018, only those with existing dogs and cats registered as of September, 2016 (the latest house rules on pets at that time) were permitted to stay in TRAG.  Once these registered pets die, these will no longer be replaced with another one. Pet owners were encouraged to spay/neuter their pets.

D.    There have been several incidents and complaints against pets and pet handlers, in spite of the existing House Rules on Pets in TRAG.

       E.   Circular No. 19-103 dated 15 June 2019 is the latest circular on House Rules

             on Pets to address the present situation.  

Based on the foregoing, attached is the present set of guidelines for strict and immediate implementation.

GUIDELINES FOR PET HANDLING IN TRAG PREMISES

1.               “No Pet Policy” in TRAG is strictly enforced.

2.              Only existing and registered pets are allowed.

3.              No ID No Entry.  Please make sure to bring your dog ID’s at all times to avoid inconvenience.

4.              Visitors are strictly prohibited to bring pets in TRAG Complex.

5.              Semi-annual registration of pets must be strictly observed to avoid penalties and possible removal from TRAG.

6.              Submission of updated Certificate of Vaccination for rabies and distemper upon registration.

7.              All pets shall be kept within the residents’ units. These are not allowed in the common areas such as The 5th Floor Podium (Swimming Pool, Gym, Social Halls, Function Rooms, Dance Studio & Kiddie Room), Auto-court, Parking levels, Sky Deck, Tower Lobbies, and Hallways.

At all times when outside the resident’s unit and in TRAG premises including passing through the Hallways, Auto-court & Parking Levels, pets must be muzzled and on a short leash and/or in a zipped up fully-covered hand-carried case/bag or pet pouch/stroller.

8.              Pets in zipped up fully-covered hand-carried case/bag or pet pouch/stroller can use the Passenger Elevator immediately beside the Service Elevator and can enter and exit the Lobby. 

9.              Pets which are NOT in zipped up fully-covered hand-carried case/bag or pet pouch/stroller must be muzzled and on leash at all times and can only use the Service Elevator and enter and exit the complex through the Service Entrance (Loading Dock) or Bridgeway.

10.         Pet owners and handlers should be responsible for cleaning after their pets. Solid Pet Excrement (stool) must be picked up, bagged, disposed of properly, and sanitize the affected area. For Liquid Pet Excrement (urine), pet owner/minder must have water or cleaning agent on-hand to sanitize the affected area.

11.         The pet owner shall be solely responsible for any injury/damage(s) to any person or property. In pet attack cases, TRAGCC reserves the right to immediately require the owner to remove the offending pet from TRAG.           

TRAGCC has the right to inhibit in court cases arising between unit owners and victims.

12.         All pet owners and minders MUST attend the required seminars on proper handling of their pets in TRAG from time to time. Failure to attend will mean violation of the House Rules and may be subject to expulsion of their pets from TRAG.

13.         Pets that are declared nuisance;

                                         i.            Upon receipt of any reasonable written complaint from two or more residents, TRAGCC reserves the right to require the pet owner to remove from TRAG any pet which  the management finds to be a nuisance.  The pet may be returned to TRAG after presentation of certification that the offensive behavior has been corrected.  A second offense will result in the permanent banning of the pet.

                                          ii.            TRAGCC shall declare a pet a nuisance if it makes persistent and excessive noise including but not limited to whining, barking, howling, meowing, hissing, cat calling, chirping, cawing, and mimicking that is audible to persons nearby for 10 continuous minutes or a total of 30 minutes over a period of 3 hours between 6am to 10pm and 5 minutes or a total of 15 minutes over a period of 3 hours between the hours of 10 pm and 6 am.

14.         Any violation of the House Rules on Pets shall be penalized as follows:
